FUNDAMENTAL · AI Image Generation and User Content Notice
> Note: This document is provided for user-facing disclosure. It must be reviewed and approved by Legal and Compliance before publication. If it conflicts with the then-current Terms of Service or Privacy Policy, the Terms of Service, Privacy Policy, and applicable laws prevail.
1. Scope
This notice describes how FUNDAMENTAL processes content you provide and content generated when you use AI image generation on the platform (including text-to-image, image-to-image, and multi-reference image generation).
2. Reference images (images you select on your device)
2.1 Account media library
Reference images you select on your device for a given generation request are not stored long-term as assets in your FUNDAMENTAL account media library.
2.2 Processing required to perform generation
To perform image-to-image or multi-reference generation, after you click Generate (or equivalent), the relevant images are transmitted from your device to FUNDAMENTAL’s servers and forwarded to third-party AI model services we integrate with to complete the computation. This processing is necessary to provide the service you requested.
2.3 Retention
In this flow, FUNDAMENTAL does not long-term store your original reference image files. For security auditing, troubleshooting, and compliance, we may retain non-content or minimized metadata (such as file count, short hash prefixes, format, and dimensions) and do not retain a complete copy that can fully reconstruct the original image.
2.4 Third-party model services
AI models are provided by independent third parties. Their processing of your data (including reference images and data involved in generation) may be governed by their terms and privacy policies. FUNDAMENTAL cannot unilaterally guarantee that a third party retains zero data internally; we seek to constrain purpose and security requirements in vendor selection and contracts, and we disclose such processing in our Privacy Policy.
3. AI candidate outputs (before you confirm)
3.1 Nature
Before you confirm an AI-generated image, it is a candidate result for preview and decision-making only and does not constitute final production artwork for your order.
3.2 Retention period
From the time the first result becomes available for your preview, candidate outputs are kept on the platform only for a short period to allow you to confirm within that window. If you do not confirm within the period, candidate outputs will be deleted, and you will not be able to select that generation result afterwards.
3.3 Length of the window
The current product rule is 10 minutes (see in-product copy for the exact wording). If delays are caused by network conditions or queueing, queueing time does not count toward the confirmation window when stated in product documentation.
4. After you confirm an AI-generated image
4.1 Purpose
After you click Confirm (or equivalent), the selected result is incorporated into your customization or order flow and is used only for production preparation, printing fulfillment, quality checks, delivery, and customer service directly related thereto.
4.2 Storage and deletion
The platform may retain the image for the period necessary for the purposes above.
After your order reaches the platform-defined status of “shipped,” the platform will delete the AI-generated image you confirmed that is associated with that order (and derived files that serve only that order and have no other lawful basis for retention), subject to the platform’s backend rules.
4.3 After-sales and disputes
If after-sales issues arise (e.g., returns, reprints, disputes), the platform may retain relevant materials for a reasonable additional period where necessary to handle the matter, as disclosed or notified separately, and delete or anonymize them after resolution. Such exceptions do not change the general principles in Sections 2 and 3.
5. Your representations and obligations
You represent that you have lawful rights or authorization for any materials you upload or provide, and that your content complies with applicable laws and platform rules. The platform may refuse generation, refuse production entry, or terminate relevant order flows for suspected infringement, illegality, or rule violations, and may take necessary measures as permitted by law and rules.
6. Relationship to other documents
If this notice conflicts with the then-current Terms of Service or Privacy Policy, the Terms of Service, Privacy Policy, and applicable laws prevail. This notice is a supplemental, easier-to-read explanation focused on the AI image generation scenario.
7. Updates
We may update this notice due to product changes, legal requirements, or vendor changes. After updates, your continued use of relevant features constitutes your acknowledgment of the updated notice (except where separate consent is legally required).
